Site Ordering and Security
When you place orders they are recorded on our secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, as required by the UK Data Protection Acts of 1984 and 1998, we follow strict security procedures in the storage and disclosure of information, which you have given to us, to prevent unauthorised access. Our security procedures mean that we may occasionally request proof of identity before we are able to disclose information to you.
Privacy Statement
At Waggers, we are committed to protecting your privacy. We use the information we collect about you to process order and to inform you about developments. When you order, we need to know your name, e-mail address, delivery address, and credit or debit card details. This allows us to process and fulfil your orders and to notify you of your order status. We also ask for your telephone number: this lets us contact you urgently if there is a problem with your order.
We use your shopping history to help us advise you about merchandise that might interest you. We also monitor customer traffic patterns and site usage to help us develop the design and layout of our website. We may also use the information we collect to occasionally notify you about important functionality change to the web site and special offers we think you'll find valuable.
Terms and Conditions
TERMS AND CONDITIONS OF BUSINESS WAGGERS
1. Interpretations and Definition
In these Terms and Conditions the following words and phrases shall have the following meanings:
- The "Carrier" means Royal Mail, Parcelforce or any other provider of delivery services chosen by the Company to provide delivery services to the Customer.
- The "Company" means Waggers, part of WCF Ltd.
- The "Customer" means a person who has placed an Order with the Company.
- "Order" means an order made in accordance with these Terms and Conditions on an Order Form or by other written or electronic means containing similar information to an Order Form, or by telephone and in each case accompanied by full payment including, where applicable, payment for postage and packing, and for transit insurance.
- "Order Form" means a pre-printed order form issued by the Company or copy of such a form.
2. Receipt of Orders
The placing of an Order by a Customer shall constitute an offer to the Company to purchase goods at the current price advertised by the Company. The Company shall have an absolute discretion as to whether or not to accept that offer.
3. Offer and Acceptance
If the company decides not to accept an offer made according to the terms of Clause 2. above, it shall inform the Customer accordingly and refund or return to the Customer all monies included with the Order, or those sums relating to that part of the Order, which is not acceptable.
4. Availability of Stock
The Company shall endeavour to supply any and all items ordered. However, the Company reserves the right not to supply any or all terms ordered by a Customer if the same are not available.
5. Time of Delivery
The delivery period stated within which the Customer will receive their order is approximate and any changes will be communicated to the Customer by the Company. The Company shall endeavour to ensure that a Customer’s Order is despatched as requested by the Customer. If the Customer is ordering more than one item the goods may be sent in instalments if certain items are out of stock. Under the Consumer Protection (Distance Selling) Regulations 2000 the Customer has the right to cancel the contract and receive a refund if the goods have not been delivered within 30 days. Please see clause 9 below for further details.
6. Title and Risk
All products ordered will remain the property of the Company until payment is received in full. All risk in the products ordered (including risk of loss and/or damage) shall pass to the Customer when delivered to the address specified by the Customer in the order.
7. Guarantee and Limitation of Liability
7.1 Guarantees
The Company warrants that products are of satisfactory quality and reasonably fit for all the purposes for which products of that kind are commonly supplied.
If a Customer is not satisfied with any item supplied by the Company, they may return that item to the Company for a replacement or a refund. This “goodwill” returns policy does not affect your legal rights under the Consumer Protection (Distance Selling) Regulations 2000.
7.2 Limitation of Liability
The products sold on this website are provided for private domestic and consumer use only. Accordingly we do not accept liability for any indirect or consequential loss, business interruption, loss of data, loss of income or profit, loss of damage to property and/or loss from claims to third parties arising out of the use of the site or for any products purchased.
There are certain liabilities we cannot exclude by law and nothing in these terms and conditions limits our liability for personal injury or death caused by our negligence.
8. Repayments due to Customers
Where the Company is liable to repay any amount to a Customer under these Terms and Conditions, that repayment shall take the form of a cheque or credit card refund for all sums.
9. Cancellation and Variation of Orders
A Customer may at any time before the day on which the order is packed, amend or cancel the order without incurring any extra charges. If the order has been packed the Customer will, in most cases, need to wait until receipt and then follow the Company’s normal returns procedure.
In line with the Company’s no quibble goodwill returns policy, the Customer can cancel the order following receipt of the goods simply by following the Company’s returns procedure. Our goodwill returns policy does not affect your legal rights under the Consumer Protection (Distance Selling) Regulations 2000.
Under the Distance Selling Regulations the Customer has the right to cancel an order for any reason up to and including the seventh working day after the date of delivery. Any Customer wishing to exercise their statutory right to cancel please notify us in writing by letter or by e-mail and return the items you do not wish to keep taking reasonable care of the goods. A refund of any sums paid will then be made by the Company. Legal rights of cancellation under the Distance Selling Regulations do not apply to certain products such as food and personalised items. Full details are available from your local Citizen’s Advice Bureau or Trading Standards Office.
10. Catalogue Prices
10.1 Unless otherwise stated, all prices shown in catalogues and price lists include any VAT, which is chargeable on the sale of a particular item.
10.2 In the event that VAT rates increase during the currency of a catalogue or price list, the Company reserves the right to pass on any such additional amounts to the Customer.
11. Text, Graphics and Photographs
All material on this site including text, graphics and photographs are owned by Waggers (WCF Ltd) and must not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, and may only be used for your personal, non-commercial use.
12. Errors
Waggers accepts no liability arising from (errors) including typographical) contained in, or any omissions from, this website. We will endeavour to make this site available at all times but cannot guarantee that it will operate without any interruptions.
13. Terms and Conditions
13.1 All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are to the fullest extent permitted by law excluded from the contract.
13.2 By using this website the Customer agrees to comply with and be bound by its terms and conditions. The Company reserves the right to change and update these terms and conditions from time to time and without notice either to comply with the law or to meet the changing business requirements. The Company recommends that the Customer revisit this page regularly to keep informed of the current terms that apply to their use of this site. By continuing to access, browse and use this website, the Customer will be deemed to have agreed to any changes or updates to the terms and conditions.
